Let's say that you were unable to take care of yourself or make the appropriate decisions regarding your health and property. This can occur when you become ill, injured or older in age. This is when someone else needs to come in and help make those decisions for you. A guardianship is when an individual is appointed as a guardian to make these tough choices. In order to assure this individual be someone that you trust, you would have to speak with a guardianship attorney in order to specify this request.

It is completely your choice in whether or not you want to appoint an individual to take guardianship. With that said, it is a very important choice and almost necessary to make. If you do not appoint someone, the court has the right to appoint someone for you. They will then decide the level of guardianship that they have over you as well. Although this may not seem like a bad option, the court may not choose a guardian that has your best interest in mind.

What are the different types of guardianships?

The types of guardianship under Virginia Law include full guardianship, limited guardianship, emergency order for adult protective services, and standby guardian. Full guardianship, which should be taken as a last resort, means that the guardian has full responsibility for making all of your decisions. In regards to limited, the appointed individual takes responsibility for specified, but not all tasks. Emergency order for adult protective services only occurs in a case of an emergency. Lastly, the standby guardian is the guardian that takes responsibility of the children once both parents have passed away. This also includes children who are mentally disabled and unable to care for themselves.
